ORDER

The claim for an increased rating for right upper extremity radiculopathy is dismissed. 

FINDING OF FACT

In January 2021, the Veteran returned a signed Appeals Satisfaction Notice requesting to withdraw this matter on appeal. 

CONCLUSION OF LAW

The criteria for withdrawal of the claim for an increased rating for radiculopathy of the right upper extremity by the appellant (or his or her authorized representative) have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55.

REASONS AND BASES FOR FINDING AND CONCLUSION

The Veteran served in the Navy from September 1965 to September 1969 and from June 1977 to June 2003. The matter is before the Board of Veterans' Appeals (Board) on appeal from a September 2014 rating decision. This matter was remanded by the Board for further evidentiary development in September 2019.

In response to the December 2020 Supplemental Statement of the Case (SSOC), the Veteran submitted a January 2021 Appeals Satisfaction Notice, indicating his intent to no longer pursue this matter currently before the Board. 

The Board notes that the Veteran's completed Appeals Satisfaction Notice includes his name, social security number, signature, and statement that the appeal is withdrawn in accordance with 38 C.F.R. §20.205. Accordingly, the Board no longer has appellate jurisdiction and can take no further action on this matter. Id.
