Citation Nr: 21041240 Decision Date: 07/08/21 Archive Date: 07/08/21 DOCKET NO. 15-08 851A DATE: July 8, 2021 ORDER The appeal is dismissed. FINDING OF FACT On May 21, 2021, prior to the promulgation of a decision in the appeal, the Board received notification from the appellant that a withdrawal of this appeal is requested. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the appellant have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 19.55. The Veteran had appealed a June 2014 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO) denying entitlement to service connection for joint pain throughout the body with polyarticular joint pain, a lumbar spine disability, a cervical spine disability, lipomas in face and back (claimed as tumors), Gulf War Illness, bronchial asthma, nasal polyps, digestive problems, a hernia, skin problems, deposits in the body, headaches, loss of feeling in both arms, and benign mandibular neoplasm, as well as entitlement to a total disability rating due to individual unemployability (TDIU) based on service-connected disabilities. After the Board remanded these issues in January 2021, a rating decision in April 2021 implemented the grant of service connection for sleep apnea and also awarded special monthly compensation based on housebound. Thereafter, the Veteran submitted a statement in May 2021 withdrawing "all pending claims & appeals." As the Veteran has withdrawn this appeal, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. MICHELLE L. KANE Veterans Law Judge Board of Veterans' Appeals Attorney for the Board L. Durham, Counsel The Board's decision in this case is binding only with respect to the instant matter decided.
