Entitlement to service connection for tumor neoplasm of the right side to include as due to exposure to herbicide agents is remanded. REASONS FOR REMAND The Veteran served on active duty in the U.S. Navy from July 1970 to June 1973. The Veteran appeals the denial of service connection for adrenal gland tumor, tumor neoplasm of the right side, sleep apnea, colon polyps, GERD, an eye disability to include glaucoma, restrictive lung disease and hypothyroidism. When these issues were last before the Board in February 2021, it was determined that further development was needed to include obtaining Social Security Administration (SSA) records and decisions. While it seems that a request has been made, the record is still without the requested records. Rather, at most, there is a cover sheet in February 2021 indicating that records were attached. In an April 2021 email, it was noted that complete SSA records were needed for the Veteran and that only a coversheet has been uploaded. The case has since been returned to Board but the requested SSA records have not been obtained. A Court or Board remand confers upon the Appellant the right to compliance with that order. Stegall v. West, 11 Vet. App. 268, 271 (1998). Accordingly, a remand is warranted so that the SSA records can be obtained and associated with the file. The matters are REMANDED for the following action: 1. Contact the Social Security Administration and obtain all relevant outstanding Social Security Administration disability records and decisions and associate them with the claims file. All efforts to obtain the Social Security records should be fully documented, and a negative response must be provided if any decisions and/or records are not available. 2. Upon completion of the above requested development and any additional development deemed appropriate, the AOJ should readjudicate the remanded issues. If any benefit sought on appeal remains denied, the Veteran and his representative should be provided with a supplemental statement of the case. An appropriate period of time should be allowed for response. T. MAINELLI Veterans Law Judge Board of Veterans' Appeals Attorney for the Board T.S. Willie The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
