Citation Nr: 21042111 Decision Date: 07/12/21 Archive Date: 07/12/21 DOCKET NO. 19-10 207 DATE: July 12, 2021 ORDER The claim for a compensable rating for deviated septum is dismissed. FINDING OF FACT Prior to the promulgation of a decision in this appeal, the Board received a written notification from the Veteran requesting this appeal be withdrawn. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION A January 2019 Statement of the Case (SOC) denied a compensable rating for deviated septum, sinusitis and right ring finger respectively. In his substantive appeal to the Board (Form 9), the Veteran only appealed the issue of increased rating for deviated septum. In February 2021 and before the Board issued a decision, the Veteran submitted a written statement withdrawing this appeal. No allegations of errors of fact or law for appellate consideration with respect to these specific matters were raised. Accordingly, the Board does not have jurisdiction to review the appeal and it is therefore dismissed. MATTHEW W. BLACKWELDER Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Q. Wang, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
