Citation Nr: 21042561 Decision Date: 07/13/21 Archive Date: 07/13/21 DOCKET NO. 18-23 934 DATE: July 13, 2021 ORDER Entitlement to service connection for tinnitus is dismissed. FINDING OF FACT In April 2021, prior to the promulgation of a decision in the appeal, the Veteran withdrew from appeal the issue of entitlement to service connection for tinnitus. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran are met. 38 U.S.C. § 7105(b)(2), (d); 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from August 1987 to April 1991. The Board notes that on his statement requesting withdrawal of the claim for service connection for tinnitus the Veteran also requested withdrawal of his claims for service connection for lumbar spine and cervical spine osteoarthritis. The Veteran, however, did not appeal those denials and as such there are no such claims currently in appellate status before the Board of Veterans' Appeals (Board). The Board may dismiss any appeal which fails to identify the specific determination being appealed. 38 U.S.C. § 7105(d). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the Veteran or by his or her authorized representative in writing. Id. In the present case, on April 8, 2021 the Veteran submitted a signed request for a withdrawal of the claim for service connection for tinnitus. Accordingly, the Veteran has withdrawn this appeal and there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. G. A. WASIK Veterans Law Judge Board of Veterans' Appeals Attorney for the Board R. E. Jones, Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
