Citation Nr: 21042778 Decision Date: 07/13/21 Archive Date: 07/13/21 DOCKET NO. 18-34 611 DATE: July 13, 2021 REMANDED The issue of entitlement to payment or reimbursement for medical care for the Veteran's daughter (P.H.) under the Camp Lejeune Family Member Program (CLFMP) pursuant to 38 C.F.R. § 17.410 is remanded. REASONS FOR REMAND The Veteran served on active duty from October 1952 to July 1972. The appellant is his daughter, P.H. This matter comes before the Board of Veterans' Appeals (Board) on appeal of a March 2018 Statement of the Case issued by the Department of Veterans Affairs (VA). The appeal was remanded in August 2019. Unfortunately, the issue of entitlement to payment or reimbursement by VA of medical expenses under the CLFMP must again be remanded in order for the Agency of Original Jurisdiction (AOJ) to upload all documentation related to the appeal to the electronic claims file. Specifically, any records prior to the March 27, 2018, Statement of the Case are not in the electronic record. If such records are unable to be located, the AOJ should make a formal finding of unavailability. The matter is REMANDED for the following actions: 1. Upload all documentation related to the claim prior to the March 2018 Statement of the Case for entitlement to payment or reimbursement by VA of medical expenses under the CLFMP to the electronic claims file. 2. If such records are unable to be associated with the record, make a formal finding of unavailability. ANTHONY C. SCIRÉ, JR Veterans Law Judge Board of Veterans' Appeals Attorney for the Board A. Odya-Weis The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
