REMANDED

Entitlement to a waiver of recovery of an overpayment of Department of Veterans Affairs (VA) pension benefits in the calculated amount of $126,041.00 is remanded.

REASONS FOR REMAND

The Board of Veterans' Appeals (Board) previously remanded this case.  It was noted that the Veteran had been sent a statement of the case (SOC) addressing the remaining issue on appeal in October 2020.  The Veteran did not file a timely Form 9; however, the Veteran has a private attorney who had not been furnished a copy of the October 26, 2020 SOC.  Accordingly, the Board remanded the case for this purpose.  The SOC was then sent to the private attorney's former address and the correspondence was undeliverable.  No further attempt was made to locate the attorney or resend the SOC.  However, the Board's March 2021 remand was sent to the private attorney's current address so a current address was of record.  Accordingly, the SOC must be sent to this current address.

The matters are REMANDED for the following action:

Send the Veteran's private attorney a copy of the October 26, 2020 SOC to the current address (as indicated on the Board's March 2021 remand) and provide the appropriate response time.
