FINDING OF FACT In February 2022, while the appeal to the Board was pending and prior to the issuance of a final decision, VA received notice that the Veteran died on January [REDACTED], 2022. CONCLUSION OF LAW Due to the death of the Veteran, the Board has no jurisdiction to adjudicate the merits of this appeal at this time. 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302 REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active duty with the U.S. Navy from August 1974 to August 1977, with subsequent service in the Naval Reserves that included active duty for training (ACDUTRA) from June 8 to June 26, 1981. This case comes before the Board of Veterans' Appeals (Board) on appeal from an August 2017 rating decision of the Department of Veterans Affairs (VA) agency of original jurisdiction (AOJ). Unfortunately, the Veteran passed away during the pendency of the appeal; VA was notified of the Veteran's death in January 2022. As a matter of law, appellants' claims do not survive their deaths. See Zevalkink v. Brown, 102 F.3d 1236, 1243-44 (Fed. Cir. 1996). By virtue of the death of the appellant, this appeal must be dismissed for lack of jurisdiction. See 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. There are, however, provisions in place to allow for an eligible person to take the Veteran's place in his appeal in order to get a final decision; this process is called substitution. The request to be substituted must be filed within one year of the Veteran's death. 38 C.F.R. § 3.1010(b).
