REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from November 1971 to April 1975. This case comes before the Board of Veterans' Appeals (Board) on appeal from a rating decision dated December 2015 by the Department of Veterans Affairs (VA) Regional Office (RO). The Veteran had a virtual Board hearing before the undersigned Veterans Law Judge in October 2021. A transcript is of record. 1. Entitlement to a total disability rating based on individual unemployability (TDIU) due to service-connected disabilities. 2. Entitlement to a compensable rating for right lower extremity radiculopathy. 3. Entitlement to a rating in excess of 20 percent for degenerative disc disease (previously diagnosed as low back syndrome). Unfortunately, the appellant died during the pendency of the appeal. As a matter of law, appellants' claims do not survive their deaths. Therefore, this appeal must be dismissed for lack of jurisdiction. 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. There are, however, provisions in place to allow for an eligible person to take the Veteran's place in his appeal in order to get a final decision. This process is called substitution.
