Citation Nr: 22016197 Decision Date: 03/21/22 Archive Date: 03/21/22 DOCKET NO. 14-25 508A DATE: March 21, 2022 ORDERED The appeal regarding entitlement to service connection for a low back disability is dismissed. FINDING OF FACT On March 7, 2022, prior to the promulgation of the decision in the appeal, the Board received notification from the Veteran that he wished to withdrawal the appeal regarding entitlement to service connection for a low back disability. CRITERIA OF LAW The criteria for withdrawal of the appeal by the Veteran regarding entitlement to service connection for a low back disability have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from January 1977 to November 1977. This matter comes before the Board of Veterans' Appeals (Board) from a January 2012 rating decision by the Agency of Original Jurisdiction (AOJ) that denied service connection for a low back disability. In March 2022, the Veteran stated that he wants to withdraw his appeal. See March 2022 Report of General Information. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the Veteran or by his authorized representative. 38 C.F.R. § 19.55. As stated above, the Veteran has withdrawn this appeal. Hence, there remain no allegations of errors of fact or law for appellate consideration. The appeal is therefore dismissed. DONNIE R. HACHEY Veterans Law Judge Board of Veterans' Appeals Attorney for the Board K. Wilson, Associate Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
