FINDING OF FACT In April 2023, the Board was notified of the Veteran's death earlier the same month. CONCLUSION OF LAW Due to the death of the Veteran, the Board has no jurisdiction to adjudicate the merits of this appeal at this time. 38 U.S.C. § 7104; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from August 1972 to August 1974 and from July 1981 to November 1984, with additional inactive duty. This matter comes before the Board of Veterans' Appeals (Board) from a February 2018 decision by the Agency of Original Jurisdiction (AOJ). In April 2023, the Social Security Administration confirmed the Veteran's death earlier the same month. Unfortunately, the Veteran, who is the appellant in this case, died during the pendency of this appeal. As a matter of law, appellants' claims do not survive their deaths. Therefore, this appeal must be dismissed for lack of jurisdiction. 38 U.S.C. § 7104(a); 38 C.F.R. § 20.1302. In reaching this determination, the Board intimates no opinion as to the merits of this appeal or to any derivative claim brought by a survivor of the Veteran. 38 C.F.R. § 20.1106. There are, however, provisions in place to allow for an eligible person to take the Veteran's place in his appeal in order to get a final decision. This process is called substitution. The request to be substituted must be filed within one year of the Veteran's death. 38 C.F.R. § 3.1010(b).
