Citation Nr: A24071069 Decision Date: 11/01/24 Archive Date: 11/01/24 DOCKET NO. 210319-223492 DATE: November 1, 2024 ORDER The appeal concerning entitlement to payment of the cost of non-Department of Veterans Affairs (VA) emergency medical services provided on November 12, 2020 to November 13, 2020, is dismissed. FINDING OF FACT While this appeal was pending, the Agency of Original Jurisdiction (AOJ) administratively approved entitlement to payment of the cost of emergency medical services provided to the Veteran on November 12, 2020 to November 13, 2020. CONCLUSION OF LAW The issue of entitlement to payment of the cost of non-VA emergency medical care provided on November 12, 2020, to November 13, 2020, has been resolved in full by administrative action; the appeal is moot. 38?U.S.C. §?7105; 38?C.F.R. §?20.801. REASONS AND BASES FOR FINDING AND CONCLUSION The appellant is a non-VA medical center that provided emergency medical services to the Veteran on November 12-13, 2020. In March 2021, the Board of Veterans' Appeals (Board) received a VA Form 10182, Decision Review Request: Board Appeal from the appellant electing the Direct Review docket to review a March 2021 Explanation of Payment issued by VA that stated the claim would not be paid because the time limit for filing had expired. The claim for payment of the cost of non-VA care provided to the Veteran on November 12-13, 2020, was then reprocessed, and administratively approved while this appeal was pending. A June 2021 Explanation of Payment informed the appellant that payment for the November 12-13, 2020, episode of care had been approved. The Board acknowledges that the approved payment amount was less than the full amount of the charges billed by the provider for the November 12-13, 2020, episode of care. If the amount paid for this episode of care is disagreeable to the appellant, they may file a separate appeal of that decision pursuant to the relevant regulatory or contractual procedures, as applicable. VICTORIA MOSHIASHWILI Veterans Law Judge Board of Veterans' Appeals Attorney for the Board K. McDonald, Counsel The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
