Citation Nr: A24055100 Decision Date: 09/11/24 Archive Date: 09/11/24 DOCKET NO. 210712-171912 DATE: September 11, 2024 ORDER Entitlement to service connection for left knee pain is dismissed. Entitlement to service connection for right knee pain is dismissed. FINDING OF FACT The appeal, including service connection claims for left and right knee pain, is dismissed. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served in the United States Air Force from July 1988 to July 1992. This matter comes before the Board of Veterans' Appeals (Board) on appeal from a July 2021 decision issued by the Department of Veterans Affairs (VA) Regional Office (RO). In that decision, the RO denied service connection of the claims and found there was no connection between the disabilities and the Veteran's military service. Following, in July 2021, the Veteran submitted a VA Form 10182 disagreeing with the decision and electing to have a hearing before a Veterans Law Judge under the Appeals Modernization Act (AMA) system. While the hearing was scheduled for a date in September 2024, it was canceled as the Veteran has withdrawn his appeal. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the appellant or by his or her authorized representative. Id. In September 2024, the Veteran's representative indicated in an appeal withdrawal letter that the Veteran wished to withdraw his AMA appeals for service connection for left and right knee pain. As there remain no allegations of errors of fact or law for appellate consideration regarding the above-mentioned issue, the Board does not have jurisdiction over this appeal, and it is dismissed. Ann K. Minami Veterans Law Judge Board of Veterans' Appeals Attorney for the Board K.M. Walker The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
