Citation Nr: A25104792 Decision Date: 12/04/25 Archive Date: 12/04/25 DOCKET NO. 230324-333674 DATE: December 4, 2025 ORDER The appeal regarding eligibility for benefits under the Department of Veterans Affairs (VA) Program of Comprehensive Assistance for Family Caregivers (PCAFC) is dismissed. FINDING OF FACT In February 2025, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran that a withdrawal of this appeal is requested. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran are met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from July 1985 to October 1985. The Appellant, J.S. is the Veteran's spouse, who filed a joint application for PCAFC with the Veteran to serve as Primary Family Caregiver. The Veteran appealed a January 2023 decision letter by the Veterans Health Administration (VHA), the Agency of Original Jurisdiction (AOJ) and requested the Board of Veterans' Appeals (Board) conduct a direct review of the evidence considered by the AOJ. See March 2023 VA Form 10182. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. See 38 C.F.R. § 20.205. Withdrawal may be made by the Veteran or by an authorized representative. Id. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. In January 2025, the Veteran filed VA Form 21-4138 and stated she "wish[ed] to withdraw all...pending claims except the debt management claim." As the Veteran explicitly and unambiguously withdrew the current appeal before the Board, the appeal is dismissed. See 38 U.S.C. § 7105, 38 C.F.R. § 20.205. DONNIE R. HACHEY Veterans Law Judge Board of Veterans' Appeals Attorney for the Board Bona, J.F. The Board's decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
