What's Changed?

Class Deviation from the Federal Acquisition Regulation (FAR) Regarding the Revised Trade Agreement Act Thresholds

Purpose: To inform the VA acquisition workforce that in accordance with FAR 1.404 and as authorized by the Civilian Agency Acquisition Council letter 2024-03, dated December 22, 2023 a class deviation is issued regarding the revised Trade Agreement thresholds.

FAR parts referenced: FAR part 22, 25 and 52.

Effective Date: January 1, 2024.

Background: Approximately every two years the trade agreements thresholds for the World Trade Organization Government Procurement Agreement (WTO GPA) and the free trade agreements (FTAs) are adjusted according to predetermined formulae under these agreements. On December 8, 2023, the United States Trade Representative (USTR) published new procurement thresholds. The new thresholds are effective as of January 1, 2024.

Applicability: This deviation applies to all contracts where the Trade Agreements Act applies.

Action Required: Contracting officers shall comply with the attached class deviation to implement the required changes.
